Can a Juvenile Be Tried as an Adult in Illinois?

A juvenile can be tried as an adult in Illinois, but only under specific circumstances. Under Illinois law, prosecutors can file a petition to transfer a minor to adult court if:

  • The child is at least 16, and

  • The offense involves an alleged murder, aggravated sexual assault, or aggravated battery with a firearm.
